The Texas Legislature (Texas Penal Code (§724) 49.01) has defined a DWI as "not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body" or "having an alcohol concentration of 0.08 or more". The district attorney only has to prove one of these statements to the jury in order to get a guilty verdict. They will use either your breath/blood test or the video that the police made of you while they were administering the field sobriety tests at the station or on the side of the road.
