Kahn & Harrison Driving while intoxicated (DWI) is a serious crime with violent and often fatal consequences.  The Texas Legislature (Texas Penal Code (§724) 49.01) has defined a DWI as "not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body" or "having an alcohol concentration of 0.08 or more". The district attorney only has to prove one of these statements to the jury in order to get a guilty verdict.   They will use either your breath/blood test or the video that the police made of you while they were administering the field sobriety tests at the station or on the side of the road.

  • 30 days-1 year in jail
  • Driver’s license suspension for 180 days-2 years

For a third offense DWI or an intoxicated assault, drivers face:

  • Up to a  $10,000 fine
  • 2 -10 years in the state penitentiary
  • Driver’s license suspension for 180 days to 2 years

For an Intoxicated manslaughter charge, drivers face:

  • Up to a $10,000 fine
  • 2-20 year in the state penitentiary
  • Drivers license suspension for 180 days-2 year

Once you have been arrested for DWI, you have 15 days to request an Administrative License Revocation Hearing (ALR Hearing) and DPS in order to try to save your license.  If a hearing is not requested within 15 days, your license will likely be suspended by DPS.  It is important to hire a qualified attorney to fight for your license at the ALR Hearing.  At Kahn & Harrison, the qualified lawyers have successfully represented many clients at ALR hearings.
